So if a medical marijuana patient smoked the night before, he or she could potentially be charged with a DUI if pulled over the next day for a traffic violation. This is also true if the patient is in an accident and the officer suspects that the driver is under the influence of alcohol or drugs. This is true even if the person was not under the influence at the time.
